Kaushal Circle is only to serve as an intermediary, providing a medium of contact and exchange of information for its users / members who have a bona fide intention to contact and/or be contacted for the purposes related to genuine existing job vacancies.

Your use of our Services is also subject to our Privacy Policy mentioned herein below, which covers how we collect, use, share and store your personal information. You agree that by clicking on “Join Now”, you are agreeing to enter into a legally binding contract with Kaushal Circle Pvt. Ltd., and becoming a member of Kaushal Circle. If you do not agree to this Contract/Terms and Conditions, do not click “Join Now” and do not access or otherwise use any of our services. Kaushal Circle App is to be subscribed/used (whether the same is paid for by you or not) only for the Purpose mentioned hereinabove and only for the exclusive use of the subscriber/registered user. Copying or downloading or recreating or sharing passwords or sublicensing or sharing in any manner which is not in accordance with these terms, is a misuse of the platform or service or product and Kaushal Circle Pvt. Ltd. reserves its rights to act in such manner as to protect its loss of revenue or reputation or claim damages including stopping your service or access and reporting to relevant authorities. In the event you are found to be copying or misusing or transmitting or crawling any data or photographs or graphics or any information available on Kaushal Circle for any purpose other than that being a bonafide Purpose, we reserve the right to take such action that we deem fit including stopping access and claiming damages
The App is a public platform with free access and Kaushal Circle, the company, its directors, employees or consultants assume no liability for the quality and genuineness of information and responses. Kaushal Circle cannot monitor the responses that a person may receive in response to information he/she has displayed on the site. The individual/company/ proprietorships/partnerships would have to conduct its own background checks on the bonafide nature of all information and responses. Kaushal Circle, its Developer or any of its employees are not responsible for conduct of any of its members for the information the member provides on the platform, and the manner in which any member uses the information available on the platform.
The platform may contain links to third party websites, these links are provided solely as convenience to You and the presence of these links should not under any circumstances be considered as an endorsement of the contents of the same, if You chose to access these website, you do so at your own risk.
You give us permission to use the information provided by you, and by your actions on Kaushal Circle App, in connection with ads, offers and other content (whether sponsored or not) that we display across our App, without any compensation to you. We use the data and information about you to make relevant suggestions and recommendation to you and others.
Whilst using this platform an obligation is cast upon you to only provide true and correct information and in case of creating a profile you undertake to at all times keep the information up to date. Kaushal Circle, its Developer, and its employees shall not be liable for any inaccuracy of information provided by you or any member on the App. Any breach of privacy or of the information provided by the member to Kaushal Circle is not the responsibility of Kaushal Circle Pvt. Ltd. or any of its employees.
You shall not use the services offered by Kaushal Circle in any manner to impair the interests and functioning of Kaushal Circle. You undertake not to duplicate, download, publish, modify or distribute the material on Kaushal Circle unless specifically authorized by Kaushal Circle in this regard. You undertake to use Kaushal Circle for yourself, and using the content of Kaushal Circle for derivative works with a commercial motive without prior consent of Kaushal Circle is strictly prohibited.
You shall not spam the platform maintained by Kaushal Circle or indiscriminately or repeatedly post jobs/vacancies, etc.. You shall not upload, post, transmit, publish or distribute any information that is unlawful, or which potentially be perceived as harmful, threatening, abusive, harassing, defamatory, libellous, obscene or racially, ethnically, or otherwise objectionable. Any conduct of the user in violation of this clause shall entitle Kaushal Circle to forthwith terminate all services to the member without notice and to forfeit any amounts to be paid by the member. Kaushal Circle Pvt. Ltd and its employees will not be liable for any such action of a member.
You agree that the information provided by you is correct and complete in all respects, and does not contain any false, distorted, manipulated, fraudulent or misleading facts or averments. You agree that the information provided by you to Kaushal Circle does not amount of violation of intellectual property rights of any other person. Kaushal Circle expressly disclaims any liability arising out of the resume insertion, information or data so fed into the network of Kaushal Circle by it members. Further, the member agrees to indemnify Kaushal Circle for all losses and actual costs incurred by Kaushal Circle due to any false, distorted, manipulated, defamatory, libellous, vulgar, obscene, fraudulent or misleading facts or otherwise objectionable averments made by the user on the network of Kaushal Circle.
You are solely responsible for maintaining confidentiality of the password for your account, and all activities and transmission performed by you and shall be solely responsible for carrying out any online or offline transaction involving credit/debit card or such other forms of instruments or documents for making such transactions and Kaushal Circle assumes no responsibility or liability for their improper use of information relating to usage of credit/debit cards used by the member online/off- line.
You hereby specifically agree that he/she shall at all times comply with the requirements of the Information and Technology Act, 2000 as also rules, regulations, guidelines, bye laws and notifications made thereunder, while assessing or feeding any resume, insertion or information/data into the network of Kaushal Circle. You agree that you unequivocally declare that in case he/she violates any provision of the Information and Technology Act, 2000 and/or rules, regulations, guidelines, byelaws and notifications made thereunder, he shall alone be responsible for all his acts, and that he alone shall be liable for civil and criminal liability thereunder or under any other law for the time being in force.
Kaushal Circle Pvt. Ltd., its directors, employees and consultants, will not be party to any legal proceedings between the members. In case Kaushal Circle Pvt. Ltd., its directors, employees or consultants, are implicated in any legal proceedings, costs will be recovered from the party that names Kaushal Circle, its directors, employees or consultants. Kaushal Circle Pvt. Ltd. will abide with any court order served on it through due process for providing access to any information of its members available with it, in terms of Section 79 of the Information and Technology Act, 2000.
Kaushal Circle has no agents and does not operate through any agents save for those specifically mentioned on the App. Kaushal Circle offers no guarantee nor warranties that there would be a satisfactory response or any response at all once the resume/ insertion or information/data is fed by the member. Kaushal Circle neither guarantees nor offers any warranty about the credentials bonafides, status or otherwise of the prospective employer/organization which downloads the resume/ insertion or information/data and uses it to contact the member. Kaushal Circle is not responsible for the content of the Employer's application form, messages, screener questions, testing assessments; required documents, or their format or method of delivery.
Kaushal Circle does not guarantee confidentiality of information provided to it, except in respect of sensitive personal data or information as per Information Technology (Reasonable security practices and procedures and sensitive personal information) Rules, 2011, by any person acquiring/using all/any information displayed on the App. Sensitive personal data or information is defined as follows passwords; financial information such as bank accounts, credit and debit card details or other payment instrument details; physiological and mental health condition, medical records; sexual orientation; medical records and history; biometric information; information received by body corporate under lawful contract or otherwise; visitor details as provided at the time of registration or thereafter; and call data records. In any event, information freely available in public domain or accessible under Right to Information Act, 2005 or any other law will not be regarded as sensitive personal data or information.
Kaushal Circle collects and shares the information for signing up and using its platform from the interested vocationally skilled worker, including but not limited to name, gender, date of birth, location, photograph, education details, work experience with employer details, videos uploading their skills, email, phone number. Kaushal Circle collects and shares the information for signing up and using platform from interested employers, including but not limited to name of the organization, size, location, name and designation of the person to be contacted, email address. We use your data to provide, support, personalize and develop our Services. Any of the abovementioned data can be accessed by other members and contact information will be used by interested members to contact you. We serve you tailored ads both on and off our services, and we promote our services to you and others. We use data to generate insights that do not identify you. We keep your data even after your account is closed.
Kaushal Circle App uses temporary cookies to store certain data (that is not sensitive personal data or information) that is used by it for technical administration of the App, research and development and for member administration. These cookies are intended to be automatically cleared or deleted when the member quits the browser application. All members, are however, encouraged to use the clear cookies functionality of their mobile phones to ensure such cleaning or deletion, since it is impossible for Kaushal Circle to guarantee, predict or provide for behaviour of every member’s equipment.
Kaushal Circle will address any discrepancies and grievances of all members with respect to its Services in a time bound manner. For this purpose, Kaushal Circle Pvt. Ltd. designates Mr. Punit Manek (Developer and Director) as the Grievance Officer, who will redress the grievances of the users expeditiously but within one month from date of receipt of grievance and who can be reached at kaushalcircle@gmail.com or punit@kaushalcircle.in
The Terms and conditions mentioned above regulate the usage of Kaushal Circle Any person using Kaushal Circle in violation of the stipulations contained in the Terms and Conditions of Kaushal Circle shall render himself/herself liable to appropriate action in a court of law both civil and criminal.
Kaushal Circle Pvt. Ltd. shall have a right to unilaterally amend these terms and condition, and the same would be notified to you.
By accepting these terms and conditions, you agree to indemnify and otherwise hold harmless Kaushal Circle , its directors, officers, employers, agents, subsidiaries, affiliates and other partners from any direct, indirect, incidental, special, consequential or exemplary damages arising out of, relating to, or resulting from your use of the services obtained through Kaushal Circle including but not limited to information provided by you or any other matter relating to Kaushal Circle.
If any dispute arises between a member/members and Kaushal Circle arising out of use of App or thereafter, in connection with the validity, interpretation, implementation or alleged breach of any provision of these Terms and Conditions, the dispute shall be referred to a sole arbitrator who shall be an independent and neutral third party identified by Developer of Kaushal Circle/Director of Kaushal Circle Pvt. Ltd., Mr. Punit Manek. Decision of the arbitrator shall be final and binding on both the parties to the dispute. The place and seat of arbitration will be New Delhi, and courts of New Delhi shall have exclusive jurisdiction.
